§1 General – Scope
(1) These general terms and conditions apply to the contractual relationship.
(2) In the event that the customer is an entrepreneur within the meaning of Section 310 I of the German Civil Code (BGB), the following applies: Our contractual terms and conditions apply exclusively; we do not recognize any terms and conditions of the customer that conflict with or deviate from our terms and conditions of sale unless we have expressly agreed to their validity in writing. Our terms and conditions of sale also apply if we carry out the delivery to the customer without reservation despite knowing that the customer's terms and conditions conflict with or deviate from our terms and conditions of sale. All agreements made between us and the customer for the purpose of executing this contract are set out in writing in this contract.
§2 Offer, contractual performance
(1) The customer can receive a non-binding request for a rental agreement via the website. Based on this data, a personal offer is created and sent to the customer, which the customer can accept by accepting the contract. Our offers remain binding for 2 weeks. We reserve the right to cancel individual reservations in exceptional cases.
(2) The content of the contract is the temporary provision of a photo booth system with the agreed accessories (hereinafter referred to as “photo booth system”) by means of a rental agreement against payment of a rental price.
§3 Rental prices, payment conditions
(1) Unless otherwise stated in the order confirmation, the rental price applies for the expected rental period stated in the contract. Early return does not lead to a reduction in the rental price. The rental price must be paid in advance.
(2) The customer is only entitled to set-off rights if his counterclaims have been legally established, are undisputed or have been recognised by us. In addition, he is entitled to exercise a right of retention to the extent that his counterclaim is based on the same contractual relationship.
(3) The rental price varies depending on occupancy and booking day and can change daily. The price displayed on the day of reservation applies. Subsequent price reductions for the booking period will not be refunded.
(4) Vouchers issued due to COVID-19 will not be paid out in the event of price reductions. The vouchers are used solely for the customer to rebook a JoMa-Rental photo booth or bouncy castle free of charge.
§4 Cancellations
(1) The customer may withdraw from the contract at any time before the start of the rental period.
(2) In case of cancellation, we will charge a flat-rate compensation calculated according to the following percentages:
- less than 48 hours before the start of the rental period: 50%
- less than 24 hours before the start of the rental period: 80%
(3) The customer has the right to prove that no damage has occurred or that the damage is significantly lower than the flat rate. In this case, no compensation will be payable.
(4) For appointments that have been rescheduled free of charge due to Covid19, the originally booked date counts in the event of cancellation. If this happened in the past, cancellation fees will apply.
§5 Loss/Damage
(1) During the period of use, our equipment must be treated with care and consideration. It must be installed in such a way that it does not cause any obstruction to users on site, is not placed in a passageway and does not block any emergency exits.
(2) The photo booth / bouncy castle must be secured against loss or damage. The customer is liable for any damage caused by the customer or others during use, with a deductible. The following damage is excluded from this:
§6 Incomplete provision of services
In the event of incomplete performance of the service by JoMa-Rental (technical malfunction, late delivery, etc.), the liability obligation is limited to a maximum of the rental price charged. Any further claims by the tenant are excluded.
§7 Retention of title
All rental items remain the property of JoMa-Rental.
§8 Exceeding the expected rental period
The customer must return the bouncy castle to us no later than one working day after the end of the rental period specified on a calendar day (service day).
§9 Right of withdrawal

Consumers have the following right of withdrawal:

If the customer is a merchant, our place of business is the place of jurisdiction; however, we are also entitled to sue the customer at the court of his or her place of residence.

§7 Retention of title

The printed material only becomes the property of the renter once it has been printed out using the photo booth.
The USB stick with the photos of the event becomes the property of the renter. Copyright and exploitation rights of the photos remain exclusively with the renter. In order to provide the service, it is necessary that the photos taken remain in the internal memory of the photo booth in addition to the USB stick. These are not read regularly and are automatically deleted from the device when the photo booth is returned. The renter agrees to this form of data storage.
§8 Exceeding the expected rental period
The customer must return the photo booth system to us one working day after the end of the rental period specified on a calendar day (performance day).
